These terms and conditions of purchase ("Terms of Purchase") govern the sale of products by SodaStream Canada Ltd. ("SodaStream", "we", "us" and "our") to you through the SodaStream Canada website at sodastream.ca ("Website”).
1. OUR CONTRACT
The sale of articles through this Web Page is carried out by SodaStream Canada Ltd, a Canadian company with registered offices at 325A Annagem Blvd., Mississauga, registered in Ontario, and with telephone 1-877-436-5866 and e-mail firstname.lastname@example.org.
The advertisements on our Website are invitations for purchase offers, and are not offers to sell. Your order is an offer to SodaStream to buy the product(s) in your order. When you place an order to purchase a product from SodaStream, we will send you an e-mail confirming receipt of your order and containing the details of your order (the "Order Confirmation E-mail"). The Order Confirmation E-mail is acknowledgement that we have received your order. It does not confirm acceptance of your offer to buy the product(s) ordered. We only accept your offer and conclude the contract of sale for a product ordered by you, when we dispatch the product to you. Your contract is with SodaStream.
These Terms of Purchase only apply to products which you buy directly from the Website. They do not apply to any SodaStream products you buy from a third party such as a retailer or other distributor. These third parties will have their own terms of sale which apply to your purchase.
You may only purchase products from our Website if you are over the age of majority in your jurisdiction of residence, or, if you are under the age of majority in the location from which you are using or accessing the Website, you have consent from a parent or guardian. By placing an order on our Website, you are confirming that you meet these requirements.
At sodastream.ca you can make a purchase as a GUEST or create a Customer Account. Account creation is very simple; we will only ask for the necessary information to speed up the purchase process. You will always have at your disposal the information of your order by logging into your account if you are a registered customer.
The images of the products on our Website are for illustrative purposes only. Although the products will materially conform to their description on the relevant product information page(s), they may differ in appearance from the images.
3. PRICING AND AVAILABILITY
All payments must be made in full prior to delivery.
All prices on our Website do not include legally applicable sales taxes and/or delivery costs.
Despite our efforts, it is always possible that some of the products may be priced incorrectly on our Website. We will normally check prices as part of our dispatch procedures so that, where the products' correct price is less than our stated price, we will charge the lower amount when dispatching the products to you. If the products' correct price is higher than the price stated on our Website, and the error could reasonably have been recognized by you as mispricing (for example, it was too good to be true), we reserve the right to reject or cancel any orders placed for products listed at the incorrect price, whether or not the order has been confirmed and your payment card charged, and we do not have to provide the products to you. If your payment card has already been charged for the purchase and your order is cancelled, we will promptly issue a credit to your payment card account in the amount of the charge.
We list estimated availability information for products sold by us on our Website on each product information page. Beyond what we say on that page or otherwise on the Website, we cannot be more specific about availability. Such estimated availability information does not constitute a guarantee that the relevant products are available. As we process your order, we will inform you by phone or e-mail as soon as possible if any products you order turn out to be unavailable, and you will not be charged for those products (or, if you have already made payment, we will refund you the full amount).
Please note that we reserve the right not to accept an order and to cancel one for any reason (other than availability), such as: the billing information was not approved, is not accurate or not verifiable, our system security didn’t confirm the order, we could not deliver to the address given by you etc.
4. AMENDMENTS TO THE CONDITIONS OF SALE
We reserve the right to make changes to our Website, policies, and terms and conditions, including these Terms of Purchase, at any time. We will publish changes on our Website. You will be subject to the Terms of Purchase and any other policies in force (displayed on our Website) at the time that you place your order for products from us and order will act as an acceptance of such policies, unless any change to those terms and conditions, policies or these Terms of Purchase is required to be made by law or government authority (in which case it may in this situation only apply to orders previously placed by you).
If any section of these Terms of Purchase is deemed invalid, void, or for any reason unenforceable, that section will be deemed severable and will not affect the validity and enforceability of any remaining section.
Delivery costs will be as displayed to you on our Website.
We do not ship to PO Boxes or APOs.
Please note that, unless otherwise stated on the Website, delivery time estimates are just that. They are not guaranteed delivery times and should not be relied upon as such. Whilst we will endeavour to ensure that products are delivered as soon as possible, delivery may be managed by a third party and we are not responsible for any delays in delivery that are outside of our control. We will make reasonable endeavour to inform you of such delays.
7. TITLE AND RISK AND USER LICENSE TERMS
Title and risk in the products you order, other than our SodaStream CO2 Cylinders, transfers to you upon the completion of delivery. Our SodaStream CO2 Cylinders remain the property of SodaStream or related affiliates of SodaStream at all times and are provided to you under licence. Please see our Cylinder Exchange Information page for further details about returning and exchanging empty SodaStream CO2 Cylinders and the User License of the SodaStream CO2 Cylinders printed on the sleeve thereof and in the user manual.
8. APPLICABLE LAW
These Terms of Purchase are governed by and construed in accordance with the laws of Ontario, Canada, and not the United Nations Convention on Contracts for the International Sale of Goods the application of which is hereby expressly excluded. We both agree to submit to the non-exclusive jurisdiction of the courts of Ontario, Canada and any courts which have the jurisdiction to hear appeals from them.
9. SODASTREAM WARRANTY
Consumers in Quebec, Canada: Quebec’s Consumer Protection Act (CQLR c P-40.1) provides you with certain rights, including warranties as to acceptable quality, safety, durability, accurate description and against hidden defects. Nothing in this section is intended to limit or replace any of your rights under the Consumer Protection Act (CQLR c P-40.1). and to the extent that it is prohibited by law, the exclusion hereunder does not apply to Quebec consumers. The exclusion set out below will otherwise apply to the fullest extent permitted by applicable law in Quebec.
In addition to and without limiting your mandatories rights under applicable consumer regulations and law, we provide a limited warranty, (for Sparkling Water Makers purchased directly from the Website), that your Sparkling Water Maker will be free of defects in materials and workmanship under normal home use for 2 (two) years following the date of purchase (“SodaStream Warranty”).
Usually we deliver all items purchased in one order at the same time, but we reserve the right to split the delivery in certain events (e.g. if some items are unavailable). Of course, you won’t be charged for any additional delivery costs
If the SodaStream Warranty is ongoing and your product is deemed faulty we are happy to replace the item with an equivalent model or, if the item you purchased is no longer available, with another item which offers substantially the same functionality. No refunds shall be given.
Other than pursuant to the SodaStream Warranty and to the fullest extent permitted by applicable law and regulations, we make no representations or warranties in relation to the products.
Please visit our help centre and see the terms of SodaStream’s limited warranty provided with your purchase and for more information on the SodaStream Warranty, including how you may exercise your rights under it.
Consumers in Quebec, Canada: Nothing in this section 10 will limit SodaStream’s or its providers’ liability with respect to the consequences of their own acts or the acts of their representatives, which is prohibited Quebec’s Consumer Protection Act (CQLR c P-40.1.).
Subject to sections 8-10 above and to the fullest extent permitted by applicable laws, applies and provides otherwise, our maximum liability to you, whether in contract, tort (including negligence) or otherwise, in connection with any purchase by you from our Website, will be limited to the price you paid for the relevant products.
Except to the fullest extent the applicable law applies and provides otherwise, SodaStream will not be liable in any circumstances for any indirect, special, or consequential loss (including loss of use, loss of profit or loss of revenue) arising in connection with any purchase by you from our Website.
In addition to Quebec, the limitation of certain liabilities is prohibited by legislation in some jurisdictions. Such legislative limitations may apply to you.
If you breach these Terms of Purchase and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Terms of Purchase.
12. FORCE MAJEURE
We are not liable for any failure or delay in the performance of our obligations resulting from causes beyond our reasonable control, including acts of God, strikes of our own employees and other unexpected interruptions.

2. CHANGE OF MIND RETURNS

You may request to cancel any order free of charge and without giving us any reason provided it has not yet been packed for shipment. We begin processing orders placed at our online store very quickly. To request a cancellation contact our customer care. You will receive confirmation if they are successful in cancelling your order prior to shipment. If cancellation is not possible, the product(s) will be delivered to you and may be returned in accordance with our Return Policy.
4. FAULTY ITEMS, SODASTREAM WARRANTY
We take great pride in everything we do and are just as disappointed as you if the product you receive is compromised in anyway. Where your product is faulty, your options may vary depending upon whether or not our Warranty Policy (“SodaStream Warranty”) or your statutory rights are still ongoing.
No purchase necessary. This Contest (the “Contest”) is intended for viewing and participation in Canada only and shall be construed and evaluated according to the laws of Canada. Please do not proceed if you are not a legal resident of Canada at time of entry or not eligible to participate in the Content according to Section 3 below.

2.Contest Period: Starting on or around and ending (the "Contest Period").
3.Eligibility: This Contest is open to legal residents of Canada, excluding residents of the province of Quebec, who have reached the age of majority in their province/territory of residence. This Contest is not open to officers, directors, employees, representatives and agents of the Contest Sponsor, their respective parents, subsidiaries and affiliates and if applicable, their advertising or promotion agencies, contest judges, contest prize suppliers, any other companies engaged in the development, production, or distribution of materials for this Contest (collectively the “Contest Entities”), and members of their immediate families (regardless of where they live), or persons domiciled with them (whether related or not). In these Official Rules (the “Rules”), “immediate family” means parents, children, siblings and spouse.
4.How To Enter: To enter the Contest, visit @vijayaselvaraju on Instagram (https://www.instagram.com/vijayaselvaraju) between March 19th and March 20th and in the contest post comments tell us what flavour you would add to your SodaStream sparkling water between Pepsi, 7Up, bubly grapefruit or blackberry (the “Comment”) to receive one (1) entry into the prize draw (see rule 6). You can also give a shoutout to up to two (2) friends, with each shoutout comment earning you one (1) additional entry into the contest. In order to enter, comment(s) must be publicly viewable. Each Comment on Instagram will be counted as one (1) entry. Each valid registration will be permitted to submit multiple entries throughout the contest period. All entrants must follow @vijayaselvaraju, @SodaStreamCanada (https://instagram.com/sodastreamcanada) and @ShopTSC (https://www.instagram.com/shoptsc)on Instagram in order to be eligible to win.
5.NO PURCHASE NECESSARY. Purchase of any product sold by the Contest Sponsor is not required and does not enhance a person’s chance of winning.
6. Prizing and Draws: There are a total of Five (5) Prizes available to be won at the conclusion of the Contest Period, each with approximate retail value of $195.94 CAD plus applicable taxes. Each prize will include one (1) SodaStream Source Starter Pack, one (1) Pepsi 440mL, one (1) 7-Up 440mL, one (1) bubly grapefruit 40mL, one (1) bubly blackberry 40mL, and My Only Bottle Sport, Turquoise 500mL. Prizes are not transferable and must be accepted as awarded, with no substitutions of any kind, except at the Contest Sponsor’s sole discretion. In the event the Prize cannot be delivered to the winner’s mailing address by the Sponsor’s preferred delivery carrier, the winner will receive a gift card to a local SodaStream retailer (as determined by the Sponsor) with an equal or greater value. 7.How To Claim A Prize:Five (5) potential Winners will be selected by representatives of The Contest Sponsor at random from the pool of eligible entrants, at 2:00 PM ET on March 21, 2022 in Toronto, ON and notified via comment reply on their winning entry and will be supervised by the Contest Sponsor CFO or Controller. Winners will be prompted to send a direct message to @SodaStreamCanada on Instagram to claim their prize. Eligible entrants must provide proof of Canadian residency, and contact details required to fulfill the prize – including but not limited to full name, address, email address and phone number. It is the winner’s responsibility to reach out to The Contest Sponsor as instructed within 24 hours of notification and provide a valid Canadian address, telephone number and email address, or their prize will be forfeited to another eligible winner. WITHIN 24 HOURS FROM THE DATE OF NOTIFICATION ON THE WINNING ENTRY, THE POTENTIAL WINNER MUST:
If a potential winner is found to be ineligible, declines to accept a Prize, cannot be located or does not respond and comply with the above requirements within 24 HOURS of Notification, the potential winner will be disqualified and will forfeit the Prize. The Contest Sponsor may then, at its sole and absolute discretion, select by random draw another eligible entrant whom the Contest Sponsor or its representatives will attempt to contact, and who will be subject to disqualification in the same manner. The Contest Sponsor will not be responsible for failed attempts to notify any potential winner. Any unclaimed Grand Prizes throughout the Contest Period will not be awarded.
8.General Conditions Applicable to All Prizes: Prizes will only be delivered to winners who have been verified and have complied with these Rules. Prizes will be delivered to the winners’ addresses as provided on their Declaration of Compliance and Release form or Prize Claim form. Deliveries will not be made to PO Box addresses. Please allow approximately two (2) to three (3) weeks for fulfillment of a Prize. No responsibility is assumed by the Contest Sponsor for any postal mail or courier delivery returned as undeliverable without a forwarding address. No responsibility is assumed by Contest Sponsor for Prizes after shipping. Winners bear all risk of loss or damages to any Prize after delivery. Contest Sponsor will bear the cost of delivery, but all other costs associated with the taking and use of the prize (including taxes, etc.) is the responsibility of the winners. Prizes must be accepted as awarded, cannot be substituted, transferred, exchanged, or surrendered for cash, except at the sole and absolute discretion of the Contest Sponsor, which reserves the right for any reason to award or substitute the Prize, or part thereof, of equal or greater value, including without limitation, a cash award.
ADDITIONAL GENERAL CONDITIONS OF PARTICIPATION:
9.By entering, entrants (i) acknowledge compliance with these Rules including all eligibility requirements and, (ii) agree to be bound by the decisions of the Contest Sponsor and/or Contest judges, made in their sole discretion, which shall be final and binding in all matters relating to this Contest, without right of appeal, including without limitation eligibility, validity, contents, and/or disqualification of an entry. Entrants who have not complied with these Rules are subject to disqualification.
10.By accepting any Prize, each winner consents to the use of his/her name, city/province of residence, voice, and statements relating to the Contest or the Contest Sponsor, and photographs or other likenesses, without further compensation, notification or permission in any publicity or advertising carried out by the Contest Sponsor or any related entities in any and all media now known or hereinafter developed without territorial or time limitation, except where prohibited by law.
11. Any attempt by an entrant or other individual, to deliberately damage any website or undermine the legitimate operation of this Contest, including but not limited to any fraudulent claims, is a violation of criminal and civil laws. Should such an attempt be made, the Contest Sponsor reserves the right to seek remedies and damages from any such individual to the fullest extent permitted by law, including criminal prosecution. Participants engaging in any of these activities may be disqualified and will forfeit any Prize won.
12.All entries become the property of the Contest Sponsor and will not be returned. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified.
13. If a dispute arises regarding who submitted an online entry, the entry will be deemed to be submitted by the authorized account holder of the email address provided at time of entry. Authorized account holder is defined as the natural person who is assigned to an email address by an Internet access or online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.
14.Entrants and/or winners assume liability for injuries caused by or claimed to be caused by participating in the Contest, by the acceptance, possession, use or misuse of any Prize awarded, including but not limited to claims/damages for personal injury, or property damage. Moreover, as a condition of entering, entrants (or their parent or legal guardian if entrant is a minor) agree: (a) to release the Contest Sponsor and Contest Entities, and each of their officers, directors, employees and agents, from any and all liability, loss or damage incurred with respect to participating in the Contest or the awarding, receipt, possession, and/or use or misuse of any Prize , (b) that under no circumstances will entrant be permitted to obtain awards for punitive, incidental, consequential, or any other damages and entrant hereby waives all rights to claim for all such damages; (c) all causes of action arising out of or connected with this Contest, or any Prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, excluding legal fees and court costs. This exclusion or limitation of liability will not apply to the extent that any applicable statue prohibits such exclusion or limitation of liability.
15.The Contest Sponsor may, at its sole discretion and without liability, terminate the Contest in whole or in part, or modify or suspend the Contest at any time, if fraud, technical failures including any network server or hardware failure, viruses, bugs, errors in programming, or communications or any other errors or other causes beyond the control of the Contest Sponsor corrupt the administration, integrity or security of the Contest or if any other factor interferes with the conduct of this Contest as contemplated by these Rules. The Contest Sponsor may do so, without notice, except as required by law. Without restricting the generality of the foregoing, and subject to the approval of the Régie des alcools, des courses et des jeux, if for any reason more entrants receive a “win” notice than the number of Prizes stated herein, the Contest Sponsor reserves the right, in its sole discretion, to terminate the Contest in whole or in part, or amend or suspend it and award only the number of Prizes stated in these Rules via a random drawing for the Prizes not yet distributed at the time the Contest is terminated, suspended or amended. In the event of early termination of the Contest, a notice will be posted online and a random drawing to award the Prize(s) will be conducted from among all eligible entries received prior to the time of termination. In no event will the number of Prizes awarded exceed the available number of Prizes as specified in these Rules. In the event that any draws are stopped, interfered with or not conducted for any reason during the Contest Period, the Contest Sponsor reserves the right, in its sole discretion, to resume conducting draws as soon as reasonably possible after any interference or cessation of such draws, or at the end of the Contest Period.
16.The Contest Sponsor and the Contest Entities do not warrant that access to the Contest Website will be uninterrupted or error-free. The Contest Sponsor and the Contest Entities are not responsible for any problems that may arise, including but not limited to; (a) lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, Web sites, or other connection, availability or accessibility problems arising in connection with or over the course of the Contest; or (b) communications failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions or hardware or software malfunctions, failures or difficulties; or (c) failure of personal computers and/or software and hardware configurations, any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error in the offering or announcement of any Prize or in any Prize notification documents; or (d) for any other errors of any kind relating to or in connection with the Contest, whether human, mechanical, clerical, electronic, or technical in nature; or (e) the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Contest; or (f) damage to a user's system occasioned by participation in this Contest or downloading any information necessary to participate in this Contest.
17.Conflicts/Discrepancies: In the event of any discrepancies between the English language Rules and the non-English language Rules, the English Rules shall prevail. In the event of a conflict between any Contest details contained in these Rules and any Contest details contained in Contest advertising materials (including, but not limited to, online, point of sale, television, and print advertising, promotional packaging, and other promotion media), the details of the Contest as set forth in these Rules shall prevail.
18.Governing Law: This Contest is subject to all Federal, Provincial, and Municipal laws. EXCEPT WITH RESPECT TO RESIDENTS OF THE PROVINCE OF QUEBEC, all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of entrant and the Contest Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the Province of Ontario without regard to Ontario conflicts of law principles. All entrants consent to the jurisdiction and venue of the Province of Ontario.
19.Invalidity: The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
